1. Acceptance of Terms
By accessing or using the services offered by Sanaul Hawk Wasif ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services. These terms apply to all clients, visitors, and users of our portfolio website and development services.
2. Services Provided
Sanaul Hawk Wasif and team provide full-stack web development, mobile app development, SaaS platform engineering, e-commerce solutions, WordPress development, API & backend development, and security auditing services. The scope, timeline, and deliverables of each project are defined in a separate project agreement or Statement of Work (SOW) agreed upon by both parties before commencement of work.
3. Project Agreements & Payments
All projects require a signed agreement or written confirmation via email before work begins. Payment schedules are defined per project — typically 50% upfront and 50% upon delivery, unless otherwise agreed. Late payments may result in paused or suspended work. All fees are non-refundable unless explicitly stated in the project agreement.
4. Intellectual Property
Upon full payment of all agreed fees, the client receives full ownership of the final deliverables including source code, design files, and documentation. We retain the right to showcase completed work in our portfolio unless the client explicitly requests confidentiality in writing. All third-party libraries, frameworks, and assets used remain under their respective licenses.
5. Client Responsibilities
Clients are responsible for providing accurate project requirements, timely feedback, required assets (images, content, credentials), and access to necessary platforms or services. Delays caused by the client may result in revised timelines or additional costs. Clients must ensure they have legal rights to all content and materials provided for use in the project.
6. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the project. We will not disclose client business data, credentials, or project details to third parties without explicit written consent. Clients agree not to share our proprietary methodologies, code structures, or internal processes with competitors.
7. Warranties & Liability
We warrant that all work delivered will be of professional quality and aligned with the agreed specifications. However, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services or delivered products. Our maximum liability is limited to the total amount paid for the specific project giving rise to the claim.
8. Revisions & Support
Each project includes a defined number of revision rounds as specified in the project agreement. Post-launch support and maintenance are available as separate service agreements. Bug fixes for issues arising directly from our code within 30 days of delivery are included at no additional cost.
9. Termination
Either party may terminate a project agreement with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. We reserve the right to terminate agreements immediately in cases of non-payment, abusive conduct, or illegal use of our services.
10. Governing Law
These Terms & Conditions are governed by the laws of Bangladesh. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the jurisdiction of courts in Bangladesh.
11. Changes to Terms
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms. We recommend reviewing these terms periodically.
